If you have a 1st for 188k and a second for 137k, but the home is valued currently at 220k, can the 2nd be partialy changed to unsecured debt as part of the repayment plan?

I am one of the hapless folks who found myself ensnared in the subprime lending fiasco, and am now faced with no other choice than to file a chapter 7. (I am in CA.) I’ve been toying with the idea of a career change, and I have been looking into several culinary arts programs at different schools. I know that I will need financial aid, but I am not sure if that’s going to be possible with a Chapter 7 under my belt. Does anyone know if a Chapter 7 will render me completely unable to obtain any educational assistance? Another thing I am wondering is, I own property (in this case my home) with another person who is not declaring bankruptcy. (My domestic partner.) My atty says that since we have no equity in our home it won’t be used as collateral, especially since we’ve managed to stay current on our payments, but that my creditors can lien her portion of the property for my debts. What does this mean exactly? And is there any way to avoid this? Any help is appreciated!

How long would it take to qualify for a home loan? Is it possible to get a loan directly after the bankruptcy? I am worried I may not be able to save the home I have now. Am I just going to have to rent for awhile?
Can you re fiance or extract equity out of your home and then file chapter 7 bankruptcy?

I own a condo in Florida and have some equity in it. My bills are too much and i’m going to file for chapter 7 bankruptcy. I want to extract any equity out of the home and pay back personal family debts and then file for chapter 7 bankruptcy. Does anyone know the proper procedure on attempting this. Should i divulge this to my attorney?

I met with a lawyer today and he told me I couldn’t file Ch 7 because I had equity in my home, and couldn’t file a ch 13 because I couldn’t prove that I could make the monthly payments…………………. What!!!!!!!!!! Do I have any options?
