I filed for bankruptcy last Oct 05 husband did not and we want to purchase a house and land that is going up for Sheriff’s Auction. Will we be able to get a loan? And where should we go to get a loan?

We been dischaged in last year May. We moved to different state and rent is almost expensive as house payment. with our family they are give us 20% down payment on the house if we can get a loan approval by direct lenders. I am one of the hapless folks who found myself ensnared in the subprime lending fiasco, and am now faced with no other choice than to file a chapter 7. (I am in CA.) I’ve been toying with the idea of a career change, and I have been looking into several culinary arts programs at different schools. I know that I will need financial aid, but I am not sure if that’s going to be possible with a Chapter 7 under my belt. Does anyone know if a Chapter 7 will render me completely unable to obtain any educational assistance? Another thing I am wondering is, I own property (in this case my home) with another person who is not declaring bankruptcy. (My domestic partner.) My atty says that since we have no equity in our home it won’t be used as collateral, especially since we’ve managed to stay current on our payments, but that my creditors can lien her portion of the property for my debts. What does this mean exactly? And is there any way to avoid this? Any help is appreciated!

Looking at filing, I think chapter 13, for credit cards, and medical bills, total about 30K, There has never been a late payment on any, credit score is 720, bit income has went to the wayward, and want to address quickly, before collection agencies. I also have about 100k equity in my home, will they want me to use that?

Will filing for bankruptcy benefit my home loan modification case (currently under review)?

My bankruptcy was discharged about 2 years ago and I’ve been doing well since. I don’t have any delinquent payments or lines of credit. I did get a vehicle lease with my father as the co-signer. I am employed full time as a store manager and make decent money (for the past 2+ years or so now.) I’m wondering if anyone else has been able to secure a home loan (and through which company) in a similar situation. Thanks!

My daughter and son in law have gone through chapter 7 bankruptcy in Oregon. They had a 1st and a 2nd mortgage (which was a home equity loan). There is an auction date set for the sale of their home, but their first mortgage company is giving them the opportunity to ’save’ the home through a loan modification before it goes to auction. My son-in-law has had recent employment and there is a slight chance they could stay in their home if the details are worked out. My question is this; can the 2nd mortgage (home equity-different lender) come back and lien the house? Or worse yet, foreclose even though the 2nd was discharged during bankruptcy? My daughter doesn’t want to bother with modifying the 1st if there’s a big chance of the reviving the 2nd. This is in the state of Oregon, but maybe the laws are the same in all states.

I have two mortgages and I plan to go into bankruptcy. I heard that I can get the second loan be erased through bankruptcy since it is ulnsecured debt, because the value of the home is totally less than even the first loan?

I have a question regarding my Home Equity Line and Foreclosure. If my home is foreclosed what happens to my home equity line? Am I still obligated to pay the home equity line? Or is it part of losing the home?

I’ve heard that if the mortgage loan and home equity line are together with the same bank, then the whole thing is foreclosed. Is this correct? Can someone please explain?

I am $60,000 in debt, all of it unsecured (medical and credit card). My yearly income is $35,000. I have to put groceries on credit cards every month because I have nothing after paying minimum payments. My credit is (obviously) bad, but my husband’s is excellent.
